These Terms of Service govern your use of the Gigred website and mobile application, including any services, functionality, and content provided by Gigred Studios Private Limited. By accessing or using the Site, you agree to be bound by these Terms of Service. Gigred Studios Private Limited is referred to as “Gigred,” “we,” or “us.” “user” or “you” refers to any person or entity accessing or using the Site.

Before using the Site, please carefully review these Terms of Service. By using the Site, creating an account, or clicking to accept or agree to these Terms of Service when prompted, you are indicating your acceptance of these terms on behalf of yourself or any other entity, including your employer. You agree to be bound by these Terms of Service and the Gigred Payment Terms incorporated into these Terms of Service by reference. Additionally, you acknowledge that you have read and understood our Privacy Policy. You should not access or use the Site if you do not agree to these Terms of Service or the Privacy Policy. The Site is intended for use by individuals at least 18 years old and of legal age to enter into a binding agreement. If you are under 18 but at least 13 years old, you may only use the Site with the permission of a parent or legal guardian. Individuals under 13 are not allowed to use the Site or any Gigred services. Accessing or using the Site confirms that you meet all the eligibility mentioned above criteria. You must only use the Site if you meet these requirements.

English is the primary language used for all texts on the Site, including these Terms of Service. If there are any discrepancies between the English and translated versions, the English version will take precedence.

 

Key Terms

  • Buyers refer to users who purchase services on Gigred.
  • Custom Offers are unique proposals created by a Seller in response to a Buyer’s specific requirements.
  • Custom Orders are requests made by Buyers to receive a Custom Offer from a Seller.
  • Gig Extras are services offered by Sellers on top of their Gig at an extra cost.
  • Gig Page is where Sellers describe their Gig and its terms while Buyers purchase the Gig and create an order.
  • Gigs refers to services offered on Gigred.
  • Order Page is where Buyers and Sellers communicate with each other regarding an ordered Gig.
  • Orders refer to formal agreements between a Buyer and a Seller after the Buyer has purchased from the Seller’s Gig Page.

 

Overview

  • To buy or sell on Gigred, you must register for a free account and provide accurate and complete information. Your account must not be fraudulent or misleading. You’re responsible for all activity on your account, and you must maintain the confidentiality and security of your password. We’re not liable for any acts or omissions by you related to your account.
  • Gigred Gigs can have a base starting price of $5, but sellers may offer some Gigs at a higher base price, as determined by them.
  • As the Payment Terms outline, buyers pay in advance to create an order on Gigred.
  • Buyers can purchase orders by clicking the Order button on a seller’s Gig page or accepting a Custom Offer.
  • Please refer to the Payment Terms to obtain information about fees and payments.
  • Sellers must complete their orders and should only cancel them occasionally or with valid reasons. Canceling orders can negatively impact the reputation and standing of Sellers.
  • Sellers’ performance and reputation determine their account statuses, which come in various levels. Higher levels offer sellers benefits such as the ability to sell their gig in multiples or offer services for higher prices through Gig Extras.
  • Users are strictly prohibited from making or receiving payments through any means other than by placing an order via the Gigred platform.
  • Buyers who purchase a Gig are entitled to all rights related to the delivered work unless the Seller has indicated otherwise on their Gig page. It’s worth noting that some Gigs may require additional payments through Gig Extras for a Commercial Use License. More information can be found in the Ownership and Gig Commercial Use Licenses sections below.
  • Gigred reserves the right to utilize all published delivered works and designs for marketing and promotional purposes related to the platform.
  • At Gigred, we value your privacy and have a Privacy Policy available for you to read.
  • Users agree to adhere to Gigred’s Community Standards, which consist of guidelines and rules governing behaviour within the Gigred Community and marketplace. These standards are in addition to the Terms of Service and are subject to periodic updates.

 

Sellers

Basics

  • Gigred Sellers create Gigs to offer their services for Buyers to purchase.
  • In addition to their Gigs, Sellers can provide Custom Offers to Buyers.
  • When you successfully sell a Gig and complete it, your account will be credited with a revenue equivalent to 90% of the purchase amount.
  • After an order is completed, Gigred credits the Sellers. Please refer to the “Orders” section below for an explanation of what constitutes a completed order.
  • To obtain additional information on receiving payments, fees, and taxes, please consult the Payment Terms.
  • Using the Google Ads platform to promote Gigs or any Gigred content is prohibited for Sellers.
  • The Seller’s rating is determined by the reviews posted by Buyers upon completion of an order. Achieving high ratings enables Sellers to progress to advanced Seller levels (refer to the “Levels” section below). However, extremely low ratings may result in the suspension of the Seller’s account in some instances.
  • To address security concerns, Gigred may temporarily deactivate a Seller’s ability to withdraw revenue as a precaution against fraudulent or unlawful activities. This may occur due to security breaches, misconduct reported by other users, or linking several Gigred accounts to a single withdrawal provider.
  • The Sellers are responsible for obtaining a general liability insurance policy with adequate coverage amounts that can account for all the risks associated with providing their services.

 

Gigs

  • Sellers can publish a limited number of active Gigs, depending on their Level status.
