Terms of Service




These "Terms of Service" regulate your use of the Gigred website and mobile application, encompassing all content, features, and services provided by Gigred Studios Private Limited, India, as applicable. Collectively, Gigred Studios Private Limited is addressed as "Gigred," "we," or "us." At the same time, "you" or "user" denotes your status as a Site user.


Before using the Site, please carefully review the Terms of Service. By utilizing the Site, creating an account, or consenting to the Terms of Service when prompted, you acknowledge and agree—either personally or on behalf of your employer or any relevant entity, if applicable—to adhere to and be bound by these Terms of Service and the Gigred Payment Terms, which are integrated herein by reference. Additionally, you affirm that you have perused and comprehended our Privacy Policy. Should you dissent from these Terms of Service or the Privacy Policy, refrain from accessing or utilizing the Site. For more detailed policies concerning Site activity and usage, refer to the articles herein.


The Site is accessible and open to individuals at least 18 years old and legally capable of entering into contracts. If you are under 18 but over 13, you may only access the Site through an account owned by a parent or legal guardian with their explicit consent. Those under 13 are prohibited from using the Site or Gigred services altogether. By using the Site, you affirm that you meet these eligibility criteria. Please meet these requirements to access or use the Site.

The primary language of these Terms of Service and all other text on the Site is English. Any translations provided by third parties are solely for convenience. If there are conflicts between the original English version and a translation, the English version will take precedence.



Key Terms


Clients are users who purchase services on Gigred.


Custom Offers are exclusive proposals that a Freelancer can create in response to specific requirements of a Client.


Custom Orders are requests made by a Client to receive a Custom Offer from a Freelancer.


Gig Packages allow Freelancers to offer services in different formats and prices. Packages can include upgrades, which lets Freelancers price their service for a basic price of over $5.​


Gig Page is where the Freelancer can describe their Gig and the Gig’s terms, and the Client can purchase the Gig and create an order.


Gig / Gigs / Services are services offered on Gigred.


Order Page is where Clients and Freelancers communicate with each other in connection with an ordered Gig.


Orders are the formal agreements between a Clients and Freelancer after a purchase was made from the Freelancer’s Gig Page.


Freelancers are users who offer and perform services through Gigs/Services on Gigred.



Overview

  • Only registered users may buy and sell on Gigred. Registration is free. When registering for an account, you agree to provide us with accurate, complete, and updated information. You must not create an account for fraudulent or misleading purposes. You are solely responsible for any activity on your account and maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your account.
  • Gigs on Gigred may be offered at a base starting price of $5. Some Gigs are offered at a base price of more than $5 as determined by the Freelancer.
  • Clients pay Gigred in advance to create an order (see Payment Terms).
  • Orders are purchased through the Continue to Order button on a Freelancer’s Gig page, Job page, or a Custom Offer.
  • For fees and payments, please read the Payment Terms.
  • Freelancers must fulfill their orders and may only cancel them occasionally or with cause. Canceling orders will affect the Freelancer's reputation and levels.
  • Freelancers gain account levels based on their performance metrics. You can read more about it in the Levels section below.
  • Users may not offer or accept payments using any method other than placing an order through the Gigred Platform.
  • When purchasing a Gig, clients are granted all rights to the delivered work unless specified by the Freelancer on their Gig page. Note: Some gigs charge additional payments for a Commercial Use License. See our "Ownership" and "Commercial Use License" sections below for more information.
  • Gigred retains the right to use all published delivered works for marketing and promotion purposes.

  • Users undertake to comply with Gigred's Community Standards, which are a set of behavior rules and guidelines applicable to the Gigred community and marketplace in addition to these Terms of Service, as updated from time to time.



Freelancers


Basics

  • Freelancers create Gigs on Gigred to allow Clients to purchase their services.
  • Freelancers may also offer Custom Offers to Clients in addition to their Gigs.
  • Every successfully completed Gig you sell will credit your account with revenue equivalent to 85%, 90%, or 95% of the purchase amount, depending on your active subscription package.
  • Gigred accredits Freelancers once an order is completed. See our "Orders" section below for a definition of a completed order.
  • For more information about receiving payments, fees, and taxes, see the Payment Terms.
  • Freelancers may not promote their Gigs or any Gigred content via the Google Ads platform.
  • The Freelancer's rating is calculated based on the order reviews posted by Clients. High ratings allow Freelancers to obtain advanced Freelancer levels. In certain cases, exceedingly low ratings may lead to the suspension of the Freelancer's account (see Levels section below).
  • Freelancers are responsible for obtaining a general liability insurance policy with coverage amounts that are sufficient to cover all risks associated with the performance of their services.


Gigs

  • Freelancers are allowed to post a select number of active gigs based on their active subscription, as further detailed here.
  • Gigs created on Gigred are User Generated Content.
  • Gigs and/or users may be removed by Gigred from the Platform for violations of these Terms of Service and/or our Community Standards, which may include (but are not limited to) the following violations and/or materials:
    • Illegal or Fraudulent services.
    • Copyright Infringement, Trademark Infringement, and violation of a third party's terms of service reported through our Intellectual Property Claims Policy, found here.
    • Adult-oriented services, Pornographic, Inappropriate/Obscene.
    • Intentional copies of Gigs.
    • Spam, nonsense, or violent or deceptive Gigs.
    • Gigs misleading to Clients or others.
    • Reselling of regulated goods.
    • Offering to prepare academic works on behalf of Clients.
    • Low-quality services or deliveries.
    • Promoting Gigred and/or Gigred Gigs through activities that are prohibited by any laws, regulations, and/or third parties' terms of service, as well as through any marketing activity that negatively affects our relationships with our users or partners.
  • Gigs that are removed for violations mentioned above may result in the suspension of the Freelancer's account.
  • Gigs that are removed for violations are not eligible to be restored or edited.
  • Gigs may include pre-approved website URLs within the Gig description and requirements box. However, Gigs containing websites promoting content that violates Gigred's Terms of Service and/or our Community Standards will be removed.
  • Gigs are required to have an appropriate Gig image related to the service offered. Freelancers must deliver the same quality of service as shown on their Gig images. Recurring deliveries that don't match the quality shown on the Gig images may cause the Freelancer's account to lose status or become permanently disabled.
  • Gigs may contain an approved Gig Video uploaded through the Gig management tools available on Gigred.
  • Statements on the Gig Page that undermine or circumvent these Terms of Service are prohibited.
  • Gigs may set up Gig Packages to offer their services in structured formats with multiple price points for the selected Gig.


Levels


Our level system enables Freelancers to track metrics that illustrate their advancement factors. As Freelancers accumulate more experience on the platform and progress to higher levels, they'll unlock new benefits and tools.

  • Gigred Freelancers can gain account levels based on their activity and performance metrics. Eligibility for the Top Rated Seller Level is also based on manual evaluation. Details about the level criteria and the relevant performance metrics can be found here.
