Payment Terms




The Payment Terms outlined below regulate any payments you initiate or receive via Gigred, managed by Gigred Studios Private Limited, India.


Gigred Studios Private Limited, India, handles card payments within and outside India. Gigred Studios Private Limited is collectively denoted herein as "Gigred," "we," or "us."


Kindly review these Payment Terms thoroughly before initiating or receiving payments via the Site. By conducting payment transactions through the Site, you acknowledge and consent, whether on your own behalf or on behalf of your employer or any other relevant entity, to be bound by these Payment Terms. These Terms complement Gigred's General Terms of Service, where relevant, collectively referred to as the "Terms of Service."



Key Terms


Capitalized terms utilized herein, yet not explicitly defined, shall hold the meanings ascribed to them in the Terms of Service.


Gigred Balance represents the combined total of your earnings as a freelancer and refunded payments from cancelled orders as a client.


Payment Services Provider(s) offer payment services to Clients and Freelancers within the Gigred platform. These services include collecting funds from Clients for purchases, transferring and disbursing funds to Freelancers, facilitating currency exchange for local currency payments and withdrawals, and managing funds associated with Gigred Balances.


Revenue refers to the earnings Freelancers generate from fulfilling orders, which they can either withdraw or utilize for purchasing on Gigred, per these Terms.



Receiving Payments


General

  • For every Gig you sell and successfully fulfil, your account is credited with revenue equivalent to 85%, 90%, or 95% of the purchase amount, depending on your subscription tier.
  • Gigred accredits Freelancers once an order is completed. For a definition of a completed order, see the "Orders" section in the Terms of Service.
  • If an order is canceled (for any reason), the funds paid will be returned to the Client’s Gigred Balance.
  • Freelancers are responsible for settling any applicable direct or indirect taxes, such as GST, VAT, or income tax, based on their residency, location, or other relevant factors according to the regulations of their jurisdiction. Freelancers affirm and assure that they adhere to and will continue to adhere to their obligations under income tax regulations in their jurisdiction. The price displayed on the Gig page or Job page encompasses all relevant taxes and fees that may apply to Freelancers.
  • Freelancer hereby designates Gigred as their limited authorized payment collection agent solely to receive payments from Clients (via its Payment Services Provider, if applicable) and forward those payments to the Freelancer. Freelancer acknowledges that when a Client makes a payment to Gigred, it is considered equivalent to payment made directly to the Freelancer. The Client's obligation to pay the Freelancer is fulfilled upon Gigred (or its Payment Services Provider, if applicable) receiving the payment, and Gigred (or its Payment Services Provider, if applicable) is responsible for transferring the funds to the Freelancer in accordance with these Payment Terms. If Gigred (via its Payment Services Provider) fails to transfer any such amounts to the Freelancer, the Freelancer's recourse is solely against Gigred and not against the Client directly. Freelancer agrees that Gigred may incorporate or reflect the terms outlined in any terms of service, receipts, disclosures, or notices, including but not limited to receipts provided to Clients, as deemed necessary or prudent by Gigred.
  • Gigred collaborates with Payment Services Providers to facilitate the collection of payments from Clients, transfer these payments from Clients to Freelancers, and manage funds related to Gigred Balances. Gigred's payment services providers carry out all payment services concerning the withdrawal of funds on the Gigred platform.


Withdrawing Revenues

  • To access your earnings, you must have an account with at least one of Gigred's Payment Service Providers, as mentioned in the withdrawal options below. Your funds available for withdrawal will be securely held in an account managed by Gigred's Payment Services Provider, which will handle all payment services, including withdrawals.
  • Your Gigred profile can only be linked to one account using the Gigred withdrawal method. Similarly, a Payment Service Provider withdrawal account can only be linked to one Gigred profile.
  • Earnings can only be withdrawn from the Revenue page after a safety clearance period. For Basic subscribers, this period is 10 days; for Standard, it's 7 days; and for Premium, it's 4 days after the order is marked as complete.
  • Freelancers can withdraw their earnings through Gigred’s designated withdrawal methods (refer to the Withdrawal Section below). To access your available earnings, click on the specified withdrawal provider to begin the withdrawal process.
  • Gigred might temporarily suspend a Freelancer's ability to withdraw earnings as a security measure to prevent fraudulent or unauthorized activity. This action may occur due to security issues, reported improper behaviour by other users, or linking multiple Gigred accounts to one withdrawal provider.
  • Withdrawals can only be made in the amount available to you.
  • Withdrawal fees vary depending on the withdrawal method.
  • Withdrawals are final and cannot be undone. We will not be able to reverse this process once it has begun.
  • In specific instances, Freelancers can withdraw their earnings in various currencies. All currency exchange transactions related to these withdrawals are handled by Gigred’s Payment Services Providers. Your Gigred Balance is consistently valued in US dollars, meaning the equivalent amount in your local currency may fluctuate daily due to exchange rate changes and involve conversion fees. Freelancers always retain the choice to withdraw their earnings in US dollars.
  • After a safety period of 60 days from the date of the last cleared payment received in their account, Freelancers can withdraw their earnings from disabled accounts. This withdrawal is contingent upon full verification of ownership of the account in question and is subject to approval by Gigred.

  • Withdraw to your PayPal Account - US$0 Fee. For a list of PayPal services by country click here.
  • Withdraw to your Payoneer Account  - US$3 per transfer. Available Worldwide.
  • Direct Deposit (NEFT) - ₹0 per transfer. Available only in India.



Purchasing


General

  • Clients pay Gigred to initiate an order from a Freelancer's Gig page, custom Offer, or Job Page by clicking the "Continue to Order" button. Gigred collaborates with Payment Services Providers to manage the collection of payments from Clients, transfer these payments from Clients to Freelancers, and administer funds related to Gigred Balances. Gigred's Payment Services Providers execute all payment services associated with collecting funds on the Gigred platform.
  • Gigred acts as the Freelancer's limited authorized agent to collect payments (via its Payment Services Provider, if applicable) from the Client and forward those payments to the Freelancer. Once Gigred (or its Payment Services Provider, if applicable) receives the payment, the Client's payment obligation to the Freelancer is fulfilled. Gigred (or its Payment Services Provider, if applicable) is responsible for transferring the funds to the Freelancer as outlined in these Payment Terms. If Gigred (via its Payment Services Provider) fails to transfer any such amounts to the Freelancer, the Freelancer's recourse is solely against Gigred, not the Client directly.
  • Across various regions, Gigred offers a range of payment options, including credit cards, PayPal, and existing Gigred balances, with potential additional methods based on location. Please refer to our comprehensive guide for details on available payment methods.
  • At the point of purchase, service fees are applied, allowing you to review and accept the total payment requested, including these fees, which encompass administrative costs. As of April 2024, the service fee is 4.5% of the purchase value.
  • You can utilize your current balance on Gigred for your upcoming purchase.
  • You may not offer Freelancers to pay, or make payments using any method other than through the Gigred platform. If you have been asked to use an alternative payment method, please report it immediately to Customer Support here.
  • You agree to receive invoices and/or payment receipts from Gigred in electronic form as PDF documents, by email or through the Site.
  • To safeguard against fraud, unauthorized transactions, and liabilities like money laundering or claims, Gigred or its Payment Services Providers collect payment information for withdrawals. Payment Services Providers may also gather additional necessary information for processing withdrawal payments. Gigred does not access the payment details shared with Payment Services Providers, and such information is governed by the Privacy Policy of the respective Payment Service Provider.   • By using any payment method and/or providing payment details for making purchases on Gigred, you represent and warrant that: (a) you are legally authorized to provide such information; (b) you are legally authorized or have permission to make payments using the payment method(s); (c) if you are an employee or agent of a company or person that owns the payment method, you are authorized by that company or person to use the payment method to make payments on Gigred; and (d) such actions do not violate any applicable law.


Currency

  • On Gigred, payments can be made in USD and INR. During checkout, the precise amount to be paid will be displayed. Unless specified otherwise, you will be billed in the currency shown on the payment page. Currency exchange services for payments in local currencies are conducted by Gigred’s Payment Services Providers.
  • Note that Gigred prices are always derived from their original US$ price; therefore, INR currency prices may change daily due to exchange rate fluctuations and may include conversion fees.
  • If you paid for an Order in INR and your Order was later canceled for any reason, the amount returned to your Gigred Balance would be based on the exchange rate as of the date of cancellation.
  • Your Gigred Balance is always valued in US$, even if it is displayed in INR at the checkout.



Taxes

  • Gigred may need to levy users indirect taxes (e.g., sales tax, VAT, or GST) or withhold taxes as mandated by relevant laws. Any such amounts collected by Gigred will be in addition to the purchase price and any other applicable fees the Client bears. Similarly, any required tax withholding's by Gigred will be subtracted from the Freelancer's revenue by applicable laws.
  • Indirect taxes are in addition to the price shown on the site, and in any event, any such taxes will always be displayed to the Client before payment.
  •  Users are responsible for paying any direct or indirect taxes, including any GST, VAT, or income tax, which may apply to them depending on residency, location or otherwise, under provisions of their jurisdiction.



Disputes and Cancellations


We advocate for our Clients and Freelancers to attempt to resolve conflicts independently. Should these efforts prove unsuccessful after utilizing the Resolution Center, or if you encounter unauthorized activity on the platform, users can contact Gigred's Support for assistance.


Basics

  • When eligible, order cancellations can be performed on Gigred by Gigred (via Customer Support or otherwise) or through the Resolution Center per order.
  • Filing a transaction dispute or reversing a payment through your payment provider or bank violates these Terms.  Doing so may temporarily or permanently disable your account. Note: Once you have filed a dispute with your payment provider, the funds will be ineligible for a refund due to our obligations towards the provider.
  • In the event that you encounter an issue related to the service provided in an order, you are encouraged to use the dispute resolution tools to attempt to resolve the matter.
  • Gigred, through its Payment Services Provider, reserves the right to cancel orders or place funds on hold for any suspected fraudulent transactions made on the Site.
  • All transfer and assignment of intellectual property to the Client shall be subject to full payment. The delivery may not be used if payment is cancelled for any reason.
  • If an order is cancelled (for any reason), the funds paid will be returned to the Client's Gigred Balance.
  • Revisions to deliveries can be performed by Freelancers based on the Freelancer's Gig and customer care. Freelancers may determine the amount of revisions they wish to offer, including no revisions.
  • Requests for revisions can be performed through the Order Page while the order is marked as Delivered.
  • Requesting to gain more services from Freelancers beyond the agreed requirements using the Request Revisions button is not allowed.


Order Cancellations

  • Gigred encourages Clients and Freelancers to resolve service disputes mutually using the Resolution Center.
  • Eligibility for requests to Gigred to cancel an order will be assessed by Gigred based on several factors, including violations of our Terms of Service and/or our Community Standards, general misconduct, and improper usage of the Delivery system. See below for Order specific eligibility.
  • Completed orders (or, where applicable, completed milestones) may be cancelled upon review by our Customer Support team up to 5 days after the Order (or Milestone) is marked as complete. Please be advised that orders cannot be partially cancelled (i.e. we can only cancel the entire Order when it is justified).
  • In rare circumstances where we find it appropriate, our Customer Support team may cancel a completed order even after 5 days have passed from its completion. In such cases, the amounts paid for the cancelled Order will be returned to the Client’s Gigred Balance. They will be deducted from the Freelancer’s Gigred Balance or, if there are no sufficient amounts in the Freelancer’s Gigred Balance, from future revenues of such Freelancer.
  • Orders are not eligible to be cancelled based on the quality of service/materials delivered by the Freelancer if the service was rendered as described on the Gig page. You may rate your experience with the Freelancer on the Order Page, including the overall level of service quality received.
  • You must use Gigred Resolution Center to address your concerns and desired resolution related to the service provided by their Freelancer before contacting Customer Support. Customer Support will not take any action against Orders where the applicable has failed to inform their Freelancer of issues related to the Freelancer’s service and will allow Freelancers to provide a resolution first. This does not include the non-permitted usage of Gigred.
  • Any non-permitted usage of Gigred encountered during an Order, after being reviewed by our Customer Support team, may cancel the Order. This includes but is not limited to, harassment, unlawful behaviour, or other violations of Gigred’s Terms of Service.

Gigred will cancel orders based on, but not limited to, the following reasons:

  • Active orders (after requirements were submitted to the Freelancer and before the Freelancer delivers on Gigred):
    • The Freelancer has been late and unresponsive for more than 24 hours while the order has been marked as Late.
    • Users are abusive towards the other party through threats of low ratings or leveraging order materials (such as logins and personal information) against each other.
    • Users supplied or included copyright/trademark infringing materials as part of their requirements or the Freelancer’s delivery.
    • The user is no longer an active Gigred user due to Terms of Service violations or the closure of their account.
  • Delivered Orders (after the Freelancer clicks Deliver Now and before the order is marked as complete):
    • The Freelancer uses the delivery system to extend the delivery due date to complete the requested service without providing the final delivery service. Note: Multiple reported offences will result in permanent suspension of your account.
    • The Freelancer delivers no files and/or proof of work related to the agreed-upon order requirements. Note: Subjectivity of the materials in question will be reviewed by our Customer Support team.
    • The Freelancer requests additional payments, on or off the Gigred platform, by withholding the final delivery of services directly related to the agreed requirements.
    • The Freelancer is withholding the final delivery of services for improved ratings.
    • Users who abuse the Request Revisions button gain more services from Freelancers beyond the agreed requirements.
    • Users who threaten to leave a damaging review to gain more services from the Freelancer not related to the agreed requirements.
  • Completed Orders (after the order is marked as complete and before the 5-day limitation):
    • Users reported using copyright/trademark infringing materials after verification and with proof.
    • Users who did not purchase commercial use rights are reported to have used the materials commercially. Note: Commercial use terms are found on the Freelancer’s Gig Page and cannot be retroactively included once the order is completed for over 5 days.
    • Gigred Customer Support will review cases of order delivery manipulation that prevent users from fully utilizing our Resolution Center, which enables the order to be marked as complete.


Chargebacks


Gigred manages instances of payment provider chargebacks and disputes on behalf of Freelancers. While outcomes may differ based on the specific reasons for each chargeback, we make concerted efforts to resolve disputes favourably for the Freelancer. Gigred (or one of Gigred’s Payment Services Providers) will reimburse Freelancers with partial or full revenue if feasible within the chargeback case. Otherwise, Freelancers will be responsible for covering the chargeback amount.


Refunds

  • Gigred does not automatically refund payments made for cancelled orders to your payment provider. Funds from order cancellations are returned to the Client's Gigred Balance and available for future Gigred purchases.
  • Refunds from the Client's Gigred Balance (i.e. refunds directly to your payment provider) can be requested from the billing page. The refund will be based on your payment method(s), amount and currency. To prevent fraud and abuse, we limit the total amount of times users can request a payment provider refund, which is subject to review by our Customer Support team. Such refunds may be subject to an additional fee.
  • Freelancers may offer a partial refund concerning a specific order to the Client. Upon acceptance by the Client of such a partial refund, the amount will be automatically refunded to the Client's payment method. If Gigred cannot refund the agreed amount to the Client's payment method, such an amount will be added to the Client's Gigred Balance.



General Terms


Modifications

  • Gigred may make changes to these Payment Terms from time to time. When these changes are made, Gigred will make a new copy of the terms available on this page.
  • You understand and agree that if you use Gigred after the date on which the Payment Terms have changed, Gigred will treat your use as acceptance of the updated Payment Terms.


Disclaimer of Warranties


Your use of the Platform and any services or items acquired through it is at your own risk. The Platform, its content, and any services or items obtained through it are furnished on an "as is" and "as available" basis, devoid of any warranties, whether express or implied. Neither Gigred nor any individual affiliated with Gigred guarantees or represents the Platform's completeness, security, reliability, quality, accuracy, or availability.


The preceding statement does not negate any warranties that are not permitted to be excluded or limited under applicable law.


Limitation on Liability


Under no circumstances will Gigred, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any nature, under any legal theory, arising from or in connection with your use or inability to use, the Platform, any websites linked to it, any content on the website or such other websites, or any services or items obtained through the Platform or such other websites. This includes any direct, indirect, special, incidental, consequential, or punitive damages, such as personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, or loss of data, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.


By assuming liability as the limited authorized payment collection agent of the Freelancer, Gigred absolves itself of any responsibility for the actions or oversights of the Freelancer.


The preceding statement does not impact any liability that cannot be excluded or limited under applicable law.


The term "Affiliate", as used here, denotes an entity that, either directly or indirectly, exercises control over, is controlled by, or is under common control with Gigred. Control in this context implies possessing over fifty per cent (50%) of the voting stock or other ownership interest or the majority of voting rights in such an entity.
