Payment Terms
The "Payment Terms" provided below pertain to payments conducted on or received via the website www.gigred.com (referred to as the "Site"), which is managed by Gigred Studios Private Limited.
Gigred Studios Private Limited handles card payments both within India and internationally. For the purposes of this document, Gigred Studios Private Limited is collectively referred to as "Gigred" and may be interchangeably denoted as "we" or "us."
Please carefully review these Payment Terms before conducting payment transactions on the Site. When you proceed to make or receive payments through the Site, you express your acceptance and agreement to be bound by these Payment Terms, either on your own behalf or on behalf of your employer or any other relevant entity, if applicable. It is important to note that these Payment Terms are in addition to Gigred's General Terms of Service.
Key Terms
Any capitalized terms utilized in this document that are not explicitly defined herein will hold the meanings ascribed to them in the Terms of Service.
Gigred Balance represents the cumulative sum of your earnings as a Seller and/or any refunded payments resulting from cancelled orders, as specified in the Gigred Terms of Service.
Payment Services Providers offer payment-related services to Buyers and Sellers through the Gigred platform. These services include gathering funds from Buyers for their purchases, transferring and disbursing funds to Sellers, facilitating currency exchange services for payments and withdrawals in various local currencies, and managing funds associated with Gigred Balances.
Revenue refers to the earnings Sellers generate from successfully fulfilled orders, which they can either withdraw as cash or utilize for making purchases on Gigred, per the terms outlined herein.
Receiving Payments
General
- Your account will be credited with revenue equivalent to 85% of the total purchase amount for every Gig you sell and satisfactorily fulfil.
- Gigred grants Sellers credit upon the completion of an order. For a comprehensive definition of a completed order, please refer to the "Orders" section within the Terms of Service.
- In the event of an order cancellation, regardless of the cause, the originally paid funds will be refunded to the Buyer's Gigred Balance.
- Sellers are responsible for settling any applicable direct or indirect taxes, including but not limited to GST, VAT, or income tax, which may be relevant based on their residency, location, or other determining factors per their jurisdiction's regulations. Sellers affirm and assure their commitment to meeting all obligations in compliance with income tax regulations in their respective jurisdictions. The price displayed on the Gig page includes all relevant taxes and fees that may apply to the Sellers.
- The Seller hereby designates Gigred as their authorized agent, with limited authority, solely to receive payments from Buyers (via Gigred's Payment Services Provider, if applicable) and forward these payments to the Seller. The Seller acknowledges that when a payment is made by the Buyer to Gigred, it is considered as if it were made directly to the Seller. The Buyer's payment obligation to the Seller is considered fulfilled upon Gigred's receipt of the payment (or its Payment Services Provider, if applicable). Gigred (or its Payment Services Provider, if applicable) is responsible for transferring the funds to the Seller under the terms outlined in these Payment Terms. If Gigred (via its Payment Services Provider) fails to transfer any such amounts to the Seller, the Seller's recourse is limited to pursuing claims against Gigred and not against the Buyer directly. The Seller also agrees that Gigred may incorporate or otherwise reference the terms contained in this agreement in various documents, including but not limited to terms of service, receipts, disclosures, or notices, as deemed necessary or prudent by Gigred.
- Gigred collaborates with Payment Services Providers to facilitate the collection of payments from Buyers, the seamless transfer of these payments from Buyers to Sellers, and the secure management of funds associated with Gigred Balances. Gigred's designated Payment Services Providers conduct all payment-related services concerning the withdrawal of funds on the Gigred platform.
Withdrawing Revenues
- To initiate a withdrawal of your earnings, it is a requirement that you have an account with at least one of Gigred's designated Payment Service Providers, as specified in the withdrawal options below. Any funds eligible for withdrawal will be securely managed on your behalf within an account held by Gigred's Payment Services Provider. Gigred's designated Payment Services Provider will furnish all payment-related services, including withdrawal services.
- Your Gigred profile may be linked to just one account for each Gigred withdrawal method. Similarly, a Payment Service Provider withdrawal account can only be connected to a single Gigred profile.
- Earnings can be withdrawn from the Revenue page after a security clearance period of 7 days once the order is marked as complete. Top Rated Sellers can withdraw revenue after a 3-day safety clearance period once the order is marked as complete.
- Sellers can access their earnings by selecting one of Gigred's withdrawal methods (please refer to the Withdrawal Section below for payment details). You need to click on the specified withdrawal provider to initiate the withdrawal process for your available revenue.
- In the interest of security, Gigred reserves the right to temporarily suspend a Seller's ability to withdraw earnings to safeguard against fraudulent or unlawful activities. This precautionary measure may be taken in response to security incidents, reported improper conduct by other users, or linking multiple Gigred accounts to a single withdrawal provider.
- Withdrawals can only be made in the amount available to you.
- Withdrawal fees vary depending on the withdrawal method.
- Withdrawals are irreversible and cannot be reversed once initiated.
- In specific instances, Sellers can withdraw their earnings in various currencies. Gigred's Payment Service Providers carry out all currency exchange services related to these withdrawals. It's important to note that your Gigred Balance is consistently based on its US$ value, meaning that the equivalent amount in your local currency may fluctuate daily due to exchange rate variations and may include conversion fees. Sellers always retain the choice to withdraw their earnings in US$.
- Sellers can request the withdrawal of their earnings from disabled accounts once a 30-day safety period has elapsed, starting from the day of the most recent cleared payment received in their account. This withdrawal is contingent upon full verification of ownership of the account in question and is subject to Gigred's approval.

- Local Bank Transfer (LBT) via Payoneer - US$3 per transfer*.
- Direct Bank Deposit (NEFT) - INR0 Fee per transfer*. Available only in India.

Purchasing
General
- Registered users can add funds to their Gigred wallet using the Deposit button, allowing quicker checkout when purchasing services on Gigred.
- Buyers pay Gigred when they create an order from a Seller's Gig page or Custom Offer by adding the gigs to their cart and using the Checkout button within the cart. Gigred collaborates with Payment Services Providers to handle the collection of payments from Buyers, the transfer of these payments from Buyers to Sellers, and the management of funds related to Gigred Balances. Gigred's Payment Services Providers carry out all payment services associated with collecting funds on the Gigred platform.
- Gigred acts as the authorized payment collection agent for Sellers, with the sole purpose of accepting payments from Buyers (via its Payment Services Provider, if applicable) and forwarding those payments to the Sellers. When Gigred (or its Payment Services Provider, if applicable) receives payment from the Buyer, it fulfills the Buyer's payment obligation to the Seller. Gigred (through its Payment Service Provider, if applicable) is responsible for transferring the funds to the Seller under the Payment Terms outlined here. If, for any reason, Gigred (via its Payment Services Provider) fails to transfer these funds to the Seller, the Seller's recourse is limited to pursuing action against Gigred and not directly against the Buyer.
- In many areas, Gigred allows customers to complete purchases using several payment options, including Debit/Credit Cards, PayPal, Gigred Credits, or the balance in their existing Gigred Wallet. For users in India, additional payment methods such as Net Banking, UPI, and popular wallets like Paytm, MobiKwik, PhonePe, and Buy Now Pay Later are also supported. Please note that specific locations may offer additional payment methods. You can find further details on the available payment methods here.
- During the purchase process, service fees are included, allowing you to review and agree to the total amount you're asked to pay. These fees are intended to cover administrative costs. There is a payment gateway fee of 4.5% of the purchase amount and a flat platform service fee of $1, both applied.
- Using any payment method other than the one provided on the Gigred Platform when dealing with Sellers is prohibited. If you are ever requested to utilize an alternative payment method, please promptly report it to Customer Support by clicking here.
- You consent to receive invoices and/or payment receipts from Gigred in electronic format, delivered as PDF documents via email or website.
- To safeguard against fraud, unauthorized transactions (such as money laundering), claims, or other potential liabilities, Gigred or Gigred's Payment Services Providers gather payment details related to withdrawals. Payment Services Providers may also collect additional information required to process withdrawal payments. It's important to note that Gigred does not have access to the payment information provided to Payment service providers, and this information is subject to the privacy policy of the specific Payment Service Provider. - When you utilize any payment method and/or furnish payment details for transactions on Gigred, you confirm and guarantee that: (a) you have the legal authority to provide such information; (b) you possess the legal authority or appropriate permission to carry out payments using the provided payment method(s); (c) if you are an employee or representative of a company or individual that owns the payment method, you have the authorization from that company or individual to employ the payment method for transactions on Gigred; and (d) these actions do not contravene any relevant laws.
Local Currencies
- You have the flexibility to make payments on Gigred in various currencies. During the checkout process, you will be presented with the precise amount due. Unless specified otherwise, your payment will be processed in the currency shown on the payment page. Gigred's Payment Services Providers manage all currency exchange services associated with payments made in local currencies. In specific situations, when certain payment methods do not support particular currencies, you may be charged in US dollars (US$) even if the price is initially displayed in a different currency. However, the exact amount to be charged (in the currency of your payment method) will always be clearly disclosed before you finalize the payment.
- Please be aware that all prices on Gigred are consistently based on their original US dollar (US$) values. As a result, prices displayed in currencies other than US dollars may fluctuate daily due to exchange rate variations and may also include conversion fees. Buyers always have the choice to switch to US dollars (US$) as their payment currency.
- If you paid for an order using a currency different from US$, and the order is subsequently canceled for any reason, the refund credited to your Gigred Balance will be determined by the exchange rate at the time of cancellation. This means the refund may differ in your local currency but will always retain the same value in US$.
- Your Gigred Balance is consistently denominated in US$, regardless of the currency it's displayed in. Consequently, if you opt to see your Gigred Balance in a currency other than US$, it may experience daily fluctuations due to exchange rate changes while retaining its equivalent value in US$. Users can always switch back to viewing their Gigred Balance in US$ by adjusting their selected display currency.
Gigred Credits
In specific situations, Gigred might provide you with credits, referred to as "Gigred Credits" or simply "Credits," for promotional or other purposes. These credits can be utilized to purchase Gigs or other services available on the platform. Your current credit balance will be visible in your account, and valid Gigred Credits will be automatically applied to your next purchase. You can also review them in your order summary after placing an order. Typically, unless stated otherwise, Gigred Credits expire three months from the date of receipt. It is important to note that Gigred Credits are meant solely to encourage the use of Gigred, and, as such, they are not exchangeable for cash, hold no monetary value, and are non-refundable. Even if your order is canceled, once Gigred Credits are used, they cannot be returned to your account. Additionally, specific terms and restrictions may be associated with Credits, which will be provided to you when you receive them. These credits can be voided if there's evidence of fraud, misuse, or a violation of the platform's terms. Gigred retains the right to modify or terminate the Gigred Credits program at its discretion. Lastly, if you or Gigred deactivate or suspend your account, any unused Gigred Credits in your report will be forfeited.
Promo Codes
Occasionally, we provide you with promotional codes, which can be used for discounted purchases of Gigs and other services available on our platform. These promo codes are exclusively valid for transactions made on Gigred and come with various time limitations, expiring after their designated period. To redeem your promo code, simply enter it during the checkout process. Failure to do so will result in the discount not being applied to your purchase. Promo codes are limited to one use per user and cannot be combined with other ongoing promotions. If your order has one or more milestones, the promo code will apply only to the initial milestone. Please note that promo codes cannot be used with Gigred Credits. Additionally, specific terms and restrictions may apply to promo codes, and these details will be provided to you when you receive them. Any evidence of fraud, misuse, or violations of our Terms of Service may lead to the voiding of promo codes. Gigred retains the right to modify or cancel promo codes at its discretion.
Taxes
- Gigred may need to comply with relevant laws by imposing indirect taxes on users, such as Sales Tax, VAT, GST, or withholding taxes. These tax amounts collected by Gigred will be in addition to the purchase price and any other fees the buyer is responsible for. Similarly, any taxes that Gigred is obligated to withhold will be subtracted from the seller's earnings, as mandated by applicable legal regulations.
- Indirect taxes are extra charges beyond the displayed site price, and in every case, these taxes will be presented to the buyer for review before making a payment.
- Users are accountable for covering any direct or indirect taxes, such as GST, VAT, or income tax, that might apply to them based on their residency, location, or other relevant factors as dictated by the regulations of their respective jurisdiction.
Disputes
We urge our buyers and sellers to try to resolve disputes between themselves. If such attempts are unsuccessful, whether after utilizing the Resolution Center or encountering unauthorized activity on the platform, users can contact Gigred's Customer Support department for assistance here.
- Order cancellations, when eligible, can be initiated on Gigred by either Gigred itself (through Customer Support or other means) or through the Resolution Center for each specific order.
- Initiating a transaction dispute or reversing a payment via your payment provider or bank constitutes a breach of these Payment Terms. Such actions may result in the temporary or permanent suspension of your account. Please be aware that once a dispute has been filed with your payment provider, the funds may become ineligible for a refund due to our obligations to the payment provider.
- If you encounter any issues concerning the service delivered within an order, we recommend utilizing the dispute resolution tools available on the platform to try and address the situation.
- Gigred, working in partnership with its Payment Services Provider, retains the authority to annul orders or temporarily freeze funds in the case of any suspected fraudulent transactions conducted on the platform.
- The transfer and assignment of intellectual property to the buyer are contingent upon the complete payment, and the delivery may not be utilized if payment is invalidated for any cause.
- In the event of an order cancellation, regardless of the reason, the funds paid will be refunded to the Buyer's Gigred Balance, from where they can be subsequently withdrawn to the buyer's bank account.
- Sellers can revise deliveries based on their Gig and customer service policies. Sellers can also decide the number of revisions they will provide, including the option of not offering any revisions.
- Revision requests can be initiated via the Order Page when the order has been marked as "Delivered."
- Utilizing the "Request Revisions" button to request additional services from sellers beyond the initially agreed-upon requirements is not permissible.
Order Cancellations
- Gigred promotes the resolution of service-related disputes through buyers' and sellers' collaborative use of the Resolution Center.
- Gigred will evaluate the eligibility of requests for order cancellations based on various factors, including breaches of our Terms of Service and Community Standards, instances of misconduct, and inappropriate utilization of the Gigred delivery system. For specific criteria related to order eligibility, please refer to the information below.
- Upon review by our Customer Support team, completed orders (or, if applicable, completed milestones) can be canceled within 7 days following their designation as complete. It's important to note that orders cannot be partially canceled; in other words, we can only cancel an entire order when there is a justifiable reason.
- In exceptional situations where we deem necessary, our Customer Support team reserves the right to cancel a completed order even if more than 7 days have elapsed since its completion. In such instances, the funds paid for the canceled order will be refunded to the Buyer's Gigred Balance and deducted from the Seller's Gigred Balance. If the Seller's Gigred Balance lacks sufficient funds, the deduction will be made from the Seller's future earnings.
- Orders cannot be canceled solely on service quality provided by the Seller, provided that the service aligns with the description on the Gig Page. You can rate your experience with the Seller on the Order Page, where you can also assess the overall quality of service received.
- Before reaching out to Customer Support, you must utilize the Gigred Resolution Center to address any concerns and specify your desired resolution regarding the service provided by your Seller. In cases where buyers have not informed their Seller about service-related issues, Customer Support will refrain from taking action on orders and allow Sellers to propose a resolution first. Please note that this exclusion does not encompass unauthorized use of Gigred.
- Upon review by our Customer Support team, any instances of non-compliant use of Gigred identified during an order may lead to the cancellation of that order. This encompasses various violations, including but not limited to harassment, unlawful activities, or breaches of Gigred's Terms of Service.
- Gigred will cancel orders based on, but not limited to, the following reasons:
Active orders (after requirements were submitted to the Seller and before the Seller delivers on Gigred)
- The Seller is late and unresponsive for more than 24 hours while the order is marked as Late.
- Users engage in abusive behavior by using threats of low ratings or exploiting order materials (such as logins or personal information) to pressure the other party.
- Users have provided or included materials in their requirements or in the Seller's delivery that infringe upon copyright or trademarks.
- The user is no longer an active Gigred user due to Terms of Service violations or the closure of their account.
Delivered Orders (after the Seller clicks Deliver Now and before the order is marked as complete)
- The Seller uses the Delivery system to postpone the deadline for delivering the requested service without providing the final service. Please be aware that repeated violations of this nature will lead to the permanent suspension of your account.
- The Seller fails to provide any files or evidence of work in connection with the agreed-upon order specifications. Please note that the determination of the materials' subjectivity will be assessed by our Customer Support team.
- The Seller seeks additional payments on or off the Gigred platform by holding back the final delivery of services directly linked to the agreed-upon requirements.
- The Seller is retaining the final service delivery to secure better ratings.
- Users who misuse the "Request Revisions" button to obtain additional services beyond the initially agreed-upon requirements from Sellers.
- Users who employ the tactic of threatening to leave a detrimental review to coerce Sellers into providing additional services that are unrelated to the agreed-upon requirements.
Completed Orders (after the order is marked as complete and before the 7-day limitation)
- Users who have been reported for utilizing materials that infringe upon copyrights or trademarks and such claims have been substantiated with verification and evidence.
- Users who did not obtain the rights for commercial use and have been reported for using the materials for commercial purposes. Please note that the terms regarding commercial use are detailed on the Seller's Gig Page and cannot be added retroactively after the order has been completed for more than 7 days.
- Gigred Customer Support will assess instances of manipulation in order deliveries that hinder users from using our Resolution Center, designed to enable the order to be officially marked as complete.
Chargebacks
Gigred examines instances of chargebacks and payment disputes initiated by payment providers on behalf of Sellers. The outcome of each case may differ depending on the specific reason for the chargeback. Still, we diligently resolve disputes in favour of the Seller. If the nature of the chargeback case permits, Gigred or one of our Payment Services Providers will reimburse the Seller partially or in full. Otherwise, the responsibility for the chargeback amount will rest with the Seller.
Refunds
- Gigred does not initiate automatic refunds to your payment provider for cancelled orders. Instead, funds from order cancellations are reimbursed to the Buyer's Gigred Balance, which remains accessible for further transactions.
- Through the billing page, you can initiate refunds from your Buyer's Gigred Balance (i.e., refunds directed to your payment provider). The refund process depends on your payment method(s), amount, and currency. To safeguard against fraudulent activity and misuse, we impose limitations on the number of times users can request a payment provider refund, which is subject to evaluation by our Customer Support team. Please note that such refunds may incur an additional fee.
- Sellers can propose a partial refund for a particular order to the Buyer. If the Buyer accepts this partial refund, the amount will be automatically reimbursed to the Buyer's chosen payment method. In cases where Gigred cannot refund the agreed-upon amount to the Buyer's payment method, it will be credited to the Buyer's Gigred Balance.
General Terms
Modifications
- Gigred reserves the right to update these Payment Terms periodically. When such changes occur, a fresh version of the terms will be provided on this page.
- You acknowledge and consent that by using Gigred after the date the Payment Terms have been modified, Gigred will regard your usage as an acceptance of the revised Payment Terms.
Disclaimer of Warranties
Your use of the website, its content, and any services or items acquired through the platform is undertaken at your discretion. The website, its content, and any services or items obtained through it are furnished on an "as is" and "as available" basis, devoid of warranties, whether express or implied. Neither Gigred nor anyone affiliated with Gigred offers any warranty or representation concerning the website's comprehensiveness, security, reliability, quality, accuracy, or availability.
The above statement does not impact any warranties that cannot be excluded or restricted under applicable law.
Limitation on Liability
Under no circumstances will Gigred, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for any type of damages, regardless of the legal theory, arising from or related to your use of or inability to use, the website, any linked websites, any content on the website or linked websites, or any services or items obtained through the website or linked websites. This includes but is not limited to, direct, indirect, special, incidental, consequential, or punitive damages. Such damages may encompass personal injury, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether the cause is tort (including negligence), breach of contract, or otherwise, even if such damages were foreseeable.
By assuming responsibility as the limited authorized payment collection agent for the Seller, Gigred and its affiliates do not accept liability for any actions or failures to act on the part of the Seller.
The above statement does not impact any liability that cannot be excluded or restricted under the applicable law.
The term "Affiliate," as used here, denotes an organization that, either directly or indirectly, holds control over, is controlled by, or shares common control with Gigred. In this context, control implies possessing more than fifty percent (50%) of the voting stock, other ownership interests, or a majority of the voting rights in such an entity.
