The following terms (these “Payment Terms”) govern payments you make or receive through www.gigred.com (the “Site”), operated by Gigred Studios Private Limited, India.
Gigred processes card payments from the U.S. and from outside the U.S. Gigred Studios Private Limited is referred hereto as “Gigred” “we” or “us”.
Please read these Payment Terms carefully before making or receiving payments through the Site. By making or receiving payments through the Site, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Payment Terms. These Terms are supplemental to Gigred’s General Terms of Service as applicable.

Taxes
- Gigred may be required by applicable laws to charge users with indirect taxes (such as Sales Tax, VAT, or GST) or to withhold taxes. Any amount Gigred will be required to collect will be in addition to the purchase amount and any other fees payable by the Client, and any amount Gigred will be required to withhold will be deducted from the Freelancer’s revenue, as required by applicable laws.
- Indirect taxes are in addition to the price shown on the site, and in any event, any such taxes will always be displayed to the Client before payment.
- Users are responsible for paying any direct or indirect taxes, including any GST, VAT, or income tax, which may apply to them depending on residency, location, or otherwise, under provisions of their jurisdiction.

Modifications
- Gigred may make changes to these Payment Terms from time to time. When these changes are made, Gigred will make a new copy of the terms available on this page.
- You understand and agree that if you use Gigred after the date on which the Payment Terms have changed, Gigred will treat your use as acceptance of the updated Payment Terms. If you do not agree to the changes in the Terms, you will have to deactivate your account. For more information, see “How to Deactivate or Permanently Delete your Account”.
- Gigred may change these Terms due to changes in the Site and in the usual course of developing our product and services, changes in any relevant feature or functionality of the Site, changes in circumstances beyond our reasonable control, to adapt to new technologies, and to address changes in law and regulatory requirements as well as security and fraud issues.
Disclaimer of Warranties
Your use of the site, its content, and any services or items obtained through the website is at your own risk. The site, its content, and any services or items obtained through the website are provided “as is” and “as available,” without any warranties, express or implied, as long as we have exercised reasonable professional diligence. Neither Gigred nor anyone associated with Gigred makes any warranty or representation regarding the completeness, security, reliability, quality, accuracy, or availability of the site.
The above does not impact any warranties that cannot be excluded or limited under applicable law.
Limitation on Liability
As long as Gigred has acted with reasonable professional diligence, Gigred, its affiliates, or their licensors, service providers, employees, agents, officers, or directors will not be liable for any damages, under any legal theory, arising from or related to your use or inability to use the site, any linked websites, content on the site or linked websites, or services or items obtained through the site or those websites. This includes, but is not limited to, direct, indirect, special, incidental, consequential, or punitive damages, such as personal injury, pain and suffering, emotional distress, loss of revenue, profits, business, anticipated savings, use, goodwill, data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
By accepting the role of the freelancer’s limited authorized payment collection agent, Gigred, and its affiliates do not assume any liability for the actions or omissions of the freelancer.
The above does not impact any liability that cannot be excluded or limited under applicable law.
The term “Affiliate” referred to herein, is an entity that, directly or indirectly, controls, or is under the control of, or is under common control with Gigred, where control means having more than fifty percent (50%) voting stock or other ownership interest or the majority of voting rights of such entity.
Governing Law
Any claims according to these payment terms related to the processing of transactions and card payments from the U.S. will be governed by and construed in accordance with the laws of the State of New York, and any claims according to these payment terms related to the processing of transactions and card payments outside of the U.S. will be governed by and construed in accordance with the laws of Cyprus.
