The access to and utilization of the Gigred website and mobile application, along with any content, features, and services provided on or through www.gigred.com or the Gigred mobile application (referred to as the "Site"), are governed by these Terms of Service. These terms apply to Gigred Studios Private Limited as applicable. The collective reference to Gigred Studios Private Limited and its subsidiaries is "Gigred," and the terms "we" or "us" refer to Gigred. The terms "you" or "user" pertain to you as a Site user.
The Site is provided and accessible to individuals at least 18 years old and have reached the legal age to enter into a binding contract. If you are under 18 but at least 13 years old, you may only utilize the Site through an account owned by a parent or legal guardian, with their explicit consent. Individuals under 13 are strictly prohibited from using the Site or Gigred services. By utilizing the Site, you affirm and guarantee that you satisfy all the eligibility mentioned above criteria. If you fail to meet these requirements, you must refrain from accessing or using the Site.

The main language of these Terms of Service and all other content on the Site is English. In the event of disparities between the original English version and any form of machine or human translation, the English version will be given precedence.
Buyer or Client refers to any authorized user of the Site, which includes those utilizing Direct Contract Services, seeking or acquiring Freelance Services, and specifically pertains to users making service purchases on Gigred.
Seller, Freelancer, or Digital Nomad is any authorized site user, including direct contract or hire services, who provides and performs services through gigs on Gigred.
Direct Contract signifies an arrangement established on Gigred between a Freelancer on Gigred and a Buyer for projects that extend beyond the scope of Gigred.
Custom Offers are exclusive proposals that a Seller can generate in response to the specific needs of a Buyer.
Gigs are services provided on Gigred.
Gig Extras are supplementary services provided on the Seller's Gig for an extra fee determined by the Seller.
Gig Packages enable Sellers to present services in various formats and with different pricing. These packages may incorporate upgrades, allowing Sellers to set a base price for their service above $5.
Gig Page is where Sellers can outline their Gig, specify its terms, and where Buyers can make purchases and create orders for the Gig.
Order Page is where Buyers and Sellers interact with each other regarding a placed Gig order.
Orders represent the official agreements between a Buyer and Seller following a purchase made through the Seller's Gig Page.
- Participation in buying and selling activities on Gigred is limited to registered users. The registration process is free. By creating an account, you commit to supplying us with accurate, comprehensive, and up-to-date information, and you must refrain from establishing an account for deceptive or misleading purposes. You bear sole responsibility for any actions performed on your account and for safeguarding the confidentiality and security of your password. We are not accountable for any actions or oversights on your part related to your account.
- On Gigred, Gigs can be initiated with a starting price of $5. Sellers may set the base price for some Gigs exceeding $5.
- Buyers make an upfront payment to Gigred when creating an order (refer to Payment Terms).
- Orders can be created using the Order button on a Seller's Gig page or through a Custom Offer.
- Please refer to the Payment Terms for information on fees and payments.
- Sellers must complete their orders and not cancel them regularly or without valid reasons. Cancelling orders can have an impact on Sellers' reputation and status.
- Sellers attain account statuses (Levels) based on their performance and reputation. Elevated levels come with benefits, such as offering services at higher prices through Gig Extras or selling their Gig in multiples.
- Users cannot offer or accept payments through any method other than initiating an order through Gigred.
- Buyers receive all rights to the delivered work upon purchasing a Gig unless the Seller specifies otherwise on their Gig page. It is important to note that certain Gigs may involve additional payments (via Gig Extras) for a Commercial Use License. For more details, refer to our "Ownership" and "Commercial Use License" sections below.
- Gigred reserves the right to utilize all publicly delivered works related to Gigred for marketing and promotional purposes.
- Users commit to adhering to Gigred's Community Standards, which encompass a set of rules and guidelines governing behavior within the Gigred community and marketplace, in addition to these periodically updated Terms of Service.
- Sellers on Gigred craft Gigs enable Buyers to acquire their services.
- In addition to their Gigs, Sellers can present Custom Offers to Buyers.
- For every Gig you sell and successfully complete, your account is credited with a revenue equivalent to 85% of the purchase amount.
- Gigred credits Sellers upon the completion of an order. Refer to our "Orders" section below for a definition of a completed order.
- For additional details on receiving payments, fees, and taxes, please consult the Payment Terms.
- Sellers are prohibited from advertising their Gigs or Gigred content using the Google Ads platform.
- The Seller's rating is determined by the reviews posted by Buyers on their orders. Favorable ratings enable Sellers to achieve higher Seller levels (refer to Levels below). In specific instances, extremely low ratings may suspend the Seller's account.
- To address security concerns, Gigred might temporarily deactivate a Seller's ability to withdraw revenue as a preventive measure against fraudulent or illicit activities. This precaution may arise due to security issues, reported improper behavior by other users, or the linkage of multiple Gigred accounts to a single withdrawal provider.
- Sellers are accountable for securing a general liability insurance policy with coverage amounts adequate to address all risks connected with the provision of their services.
- Sellers can publish a specific number of active Gigs determined by their Level status.
- 7 Gigs for Sellers without a Level status.
- 10 Gigs for Level 1 Sellers.
- 20 Gigs for Level 2 Sellers.
- 30 Gigs for Top Rated Sellers.
- Gigs formulated on Gigred are considered user-generated content.
- Gigred reserves the right to remove Gigs and/or users from the Site for violating these Terms of Service and/or our Community Standards. This may encompass various violations and/or materials, including (but not limited to):
- Illegal or Fraudulent services.
- Copyright Infringement, Trademark Infringement, and violation of a third party's terms of service are reported through our Intellectual Property Claims Policy, found here.
- Adult-oriented services, Pornographic, Inappropriate/Obscene
- Intentional copies of Gigs.
- Spam, nonsense, or violent or deceptive Gigs.
- Gigs misleading to Buyers or others.
- Reselling of regulated goods.
- Offering to prepare academic works on behalf of Buyers.
- Low-quality services or deliveries
- Promoting Gigred and/or Gigred Gigs through activities prohibited by any laws, regulations, and/or third parties' terms of service and engaging in any marketing activity that adversely affects our relationships with users or partners is prohibited.
- Gigs removed for the violations mentioned above may lead to suspending the Seller's account.
- Gigs that are removed due to violations cannot be reinstated or modified.
- Gigs may be excluded from our listings due to inadequate performance and/or user misconduct.
- Gigs may incorporate pre-approved website URLs within the Gig description and requirements box. However, Gigs that feature websites promoting content that contravenes Gigred's Terms of Service and/or our Community Standards will be taken down.
- Gigs must feature a suitable Gig image relevant to the offered service. All Sellers have the option to upload two additional Gig images. Sellers must provide the same level of service quality as depicted in their Gig images. Consistent deliveries that do not meet the quality displayed in the Gig images may result in the Seller's account losing Seller status or being permanently disabled.
- Gigs can include an authorized Gig Video uploaded using the Gig management tools provided on Gigred.
- Gig providers in specific categories that meet eligibility criteria can create Gig Packages, presenting their services in organized formats with various price options for the chosen Gig.
- Gig Extras refer to supplementary services provided by the seller, offered in addition to their main Gig, with an extra cost determined by the seller.
- Gig Extras may be removed if there are breaches of our Terms of Service and/or Community Standards. Refer to the Gigs section above for a comprehensive list of services that contravene our Terms of Service. Gigs may be taken down if violations are identified in the associated Gig Extras.
- Gig Extras services must be related to the core service and form a part of the deliverables specified in the order.
- Gig Extras can encompass various service categories that contribute to delivering a higher-quality service.
- Sellers can choose to prolong the Order duration for every added Gig Extra. This is done to account for the additional time required to fulfill the extra service.
At Gigred, our focus is on assisting sellers in maximizing their skills. We aim to provide top-performing sellers with valuable tools to expand their business. Sellers who actively promote themselves may experience increased customer satisfaction. Moreover, by consistently delivering on time and maintaining high quality and ratings, Gigred may grant them new statuses, along with special opportunities, benefits, and associated tools.
- Gigred sellers can gain different account levels determined by their activity, performance, and reputation. The criteria for advancement can be located here.
- The progression in levels is regularly updated through an automated system.
- Sellers can reach Level 1, 2, and Top Rated statuses.
- Sellers who struggle to uphold a high-quality service, encounter a significant decline in ratings, or fail to meet deadlines face the possibility of losing their seller status and its associated benefits. Instances such as late deliveries, account warnings, and cancellations can result in a seller moving to a different level.
- Higher levels offer additional advantages to their owners, such as listing Gigs at elevated prices through Gig Extras or selling Gigs in multiples.
Top Rated Sellers
- Gigred editors manually select Top Rated Sellers through an ongoing review process, considering factors like seniority, sales volume, outstanding ratings, exceptional customer care, high order completion rates, and community leadership. In certain categories, sellers may need to fulfill specific eligibility criteria, such as mandatory tests or verification steps. Top Rated Sellers enjoy enhanced features compared to previous levels, including exclusive access to beta features and VIP support.
- Gigred continually assesses Top Rated eligibility to uphold the quality standards and expectations associated with this status. Based on this ongoing evaluation, Gigred reserves the right to modify the Top Rated Seller status. Furthermore, Top Rated Sellers who face challenges in maintaining high-quality service, such as a significant decline in ratings, failure to meet deadlines, an increased cancellation rate, or violations of our Terms of Service and/or Community Standards, also run the risk of losing their Top Rated status and the associated benefits.
Gigred sellers can utilize various exclusive features to tailor the presentation of their services.
- Sellers can also send personalized Custom Offers that cater to the specific requirements of a buyer.
- Sellers create Custom Offers by specifying the service details, price, and expected delivery time.
- Custom Offers are sent from the conversation page.
- Services offered via Custom Offers must adhere to Gigred's Terms of Service and/or our Community Standards, avoiding violations.
- For Gigs and Custom Offers exceeding $100, you can incorporate a maximum of six project milestones. The minimum amount for each milestone is $50, and the project must consist of at least two milestones. Each milestone is paid and delivered separately in alignment with the description and timelines specified in the Gig or Custom Offer.
- After a milestone is delivered and marked as completed, buyers can proceed with the order and make payment for the next milestone or discontinue the order. If the buyer does not pay for the next milestone within 10 days of accepting the previous milestones, the subsequent milestones will not commence. If there is no acceptance or modification request submitted within 8 days after being marked as delivered, the milestone will be automatically marked as complete. However, in this scenario, all subsequent milestones will not be initiated.
Shipping Physical Deliverables
Certain services on Gigred involve physical delivery, such as arts and crafts or collectible items. In such Gigs, sellers can establish a shipping pricing factor.
- Gigs with an associated shipping pricing factor involve the dispatch of physical deliverables to buyers.
- The shipping costs added to a Gig specifically refer to the expenses sellers incur for delivering physical items to buyers.
- Buyers acquiring Gigs that involve physical delivery will be prompted to furnish a shipping address.
- Sellers are accountable for all shipping arrangements once the buyer provides the shipping address.
- Gigred does not manage or assure the shipping, tracking, quality, or condition of items, including their delivery, and is not accountable for any damages or other issues arising from the shipping process.
- Including a tracking number is an effective method to prevent shipping-related disputes. Please enter the tracking number, if available, on the Order Page when delivering your work.
- Offering direct payments to sellers using payment systems external to the Gigred platform is not allowed.
- Gigred reserves the right to utilize all publicly published delivered works for marketing and promotional purposes on the Gigred platform.
- Buyers can use the "Post a Project" feature to seek a particular service. However, services requested on Gigred must comply with the platform's guidelines. Users are advised to avoid using the "Post a Project" feature for purposes other than searching for services on Gigred.
- To understand the fees and taxes associated with making payments through the Gigred platform, please consult the Payment Terms.
- Furthermore, buyers can request a custom order that caters to their specific requirements and receive a customized offer from sellers through the site.
- You cannot propose or pay sellers using any method other than the Gigred Platform. If you have been requested to use an alternative payment method, please promptly report it to Customer Support.
- Upon payment confirmation, your order will be generated and assigned a distinct Gigred order number (#GO).
- Sellers must submit completed files and/or proof of work through the "Deliver Work" button on the Order page by the service purchased and advertised on their Gig.
- The "Deliver Work" button should not be misused by sellers to bypass the Order guidelines outlined in these Terms of Service. Employing the "Deliver Work" button when an order has not been fulfilled may lead to the cancellation of that order after a review, impact the seller's rating, and result in a warning to the seller.
- An order is deemed complete once marked as delivered and subsequently accepted by a buyer. If the order is not accepted, and no request for modification is submitted within 2 days after the order is marked as delivered, it will be automatically marked as complete. The buyer can extend this period by up to 4 additional days.
- We strongly urge our buyers and sellers to attempt to resolve conflicts independently. If this proves unsuccessful, either after utilizing the Resolution Center or encountering non-permitted usage on the site, users can seek assistance from Gigred's Customer Support department by contacting them. For additional details regarding disputes, order cancellations, and refunds, please consult the Payment Terms.
- In an order with milestones, a milestone is considered complete once it is delivered by the seller and accepted by the buyer. If no acceptance or request for modification is submitted within 8 days after being marked as delivered, the milestone is automatically marked as complete. However, the order will be halted in such cases, and all subsequent milestones will not commence. After a milestone is delivered and accepted, buyers can either continue with the order and pay for the next milestone or stop the order. If the buyer does not pay for the next milestone within 10 days of accepting the previous milestones, the order under the next milestone will not initiate. It's important to note that stopping future milestones does not cancel the current ordered milestone.
- Certain Gigs offering local services may necessitate in-person meetings between buyers and sellers for the service to be performed. In such instances, users must acknowledge that Gigred does not guarantee buyers' or sellers' behavior, conduct, safety, suitability, or ability. Both parties agree that any risks associated with their meeting and/or the use or performance of local services are solely their responsibility. Gigred bears no responsibility or liability for any local services provided by the sellers. In cases where the service is carried out at the buyer's premises, buyers are advised to maintain appropriate insurance policies to cover their liability as the premises owner. Gigred's Terms of Service and Community Standards apply to orders conducted outside the marketplace, encompassing restrictions on Unlawful Use, Inappropriate Behavior and language, and Targeted Abuse, among others.
- Upon a buyer placing a Gig order, the seller receives notifications through email and on the site when logged into their account.
- Sellers must adhere to the delivery time they specified when creating their Gigs. If they fail to do so and an order is marked as late, the buyer can cancel it, which may adversely affect the seller's status.
- Sellers must utilize the "Deliver Completed Work" button (located on the Order page) to send completed files and/or proof of work to mark the order as delivered.
- Users are accountable for scanning all transferred files for viruses and malware. Gigred disclaims responsibility for any damages arising from site usage or the use of content or files transferred.
- Buyers can use the "Request Revisions" feature on the Order Page when an order is marked as delivered. This option is available if the delivered materials do not align with the seller's description on their Gig page or fail to meet the requirements initially communicated to the seller at the commencement of the order process.
- Buyer reviews play a crucial role in Gigred's rating system. Please refer to this page for more information on Gigred's review system.
- Reviews will only be deleted if there are evident violations of our Terms of Service and/or Community Standards.
- To ensure the integrity of our review system, all reviews must originate from legitimate and eligible orders, as outlined in further detail here. Purchases intended to manipulate seller ratings or exploit the Gigred platform will permanently suspend all associated accounts.
- Prohibitions include withholding the delivery of services, files, or information necessary to complete the Gig's service to secure favorable reviews or additional services. Sellers cannot seek to remove buyer feedback reviews through mutual cancellations.
- After the seller and buyer have concluded their reviews or after the relevant review period has elapsed, all submitted reviews become publicly visible.
Disputes and Cancellations
We encourage both buyers and sellers to attempt to resolve conflicts independently. If, for any reason, this proves unsuccessful after using the Resolution Center or encountering non-permitted usage on the site, users can seek assistance from Gigred's Customer Support. Please refer to the Payment Terms for further details on disputes, order cancellations, and refunds.
User Conduct and Protection
Gigred empowers individuals globally to create, share, sell, and acquire various services at unparalleled value. The services available on Gigred showcase the diversity of a growing Gig economy. Members within the Gigred Community interact and connect through orders, social media, and Gigred's Community Forums.
Gigred upholds a welcoming, community-minded, and professional atmosphere. Users are encouraged to maintain this spirit while engaging in Gigred-related activities or extensions. This section outlines the expected conduct that users should adhere to when interacting with each other on the platform.
To report a breach of our Terms of Service and/or our Community Standards, instances of user misconduct, or inquiries regarding your account, please contact our Customer Support.
- Seeking or sharing email addresses, Skype/IM usernames, telephone numbers, or any other personal contact details to communicate outside of Gigred to bypass or exploit the Gigred messaging system or platform is prohibited.
- Any essential exchange of personal information required to proceed with a service can be shared within the Order Page.
- Gigred offers no assurance regarding the quality of service provided to buyers. Users can use the dispute resolution tools available on the Order Page if needed.
- Gigred does not offer protection for users who interact outside the Gigred platform.
- All information and file exchanges must be conducted solely within Gigred's platform.
- Inappropriate, offensive, or violent language in messages will not be tolerated. It may lead to an account warning or the suspension/removal of your account.
- Gigred welcomes users of all backgrounds. You agree not to discriminate against any other user based on gender, race, age, religious affiliation, sexual orientation, or any other criteria, recognizing that such discrimination may lead to suspending or removing your account.
- Users cannot submit proposals or encourage parties introduced through Gigred to enter contracts, engage, or make payments outside the Gigred platform.
- Users who attempt to defame competing sellers by placing orders on rival services may have their reviews removed or face additional account-related actions determined upon review by our Trust & Safety team.
- Users should avoid spamming or soliciting previous buyers or sellers to manipulate the removal or modification of reviews or the cancellation of orders, particularly if such actions do not comply with the Order Cancellation or Feedback policies.
- Users can report Gigs to Customer Support if they believe the reported Gig violates Gigred’s Terms of Service due to its replicated similarity to pre-existing services (copycat Gigs).
- Sellers affirm that any content featured in their Gigs is original work created by them and does not violate any third-party rights, including but not limited to copyrights, trademarks, or service marks. If certain music or stock-footage media is included in the Gigs, Sellers assert that they possess a valid license to use such music and/or footage and to incorporate them into the Gigs.
- Gigred will address clear and comprehensive notices regarding alleged copyright or trademark infringement. You can review our Intellectual Property claims procedures here.
Users might receive an account warning for violations of our Terms of Service and/or our Community Standards or any reported user misconduct reviewed by our Trust and Safety team. This warning will be sent to the user's email address and displayed on the site. Warnings do not impose restrictions on account activity but, depending on the severity of the violation, can result in the loss of Seller statuses or permanent account disablement.
Adult Services & Pornography - Gigred prohibits the exchange of adult-oriented or pornographic materials and services.
Inappropriate Behavior & Language - Interactions on Gigred should be characterized by friendliness, constructive engagement, and professionalism. Gigred strongly discourages bullying, harassment, and hate speech directed towards others. Our platform provides users with a means for exchanging messages, rating orders system, and engagement opportunities on broader platforms such as our Community Forum and Social Media pages.
Phishing and Spam - Ensuring the security of our members is of utmost importance. Any efforts to disseminate or transmit malicious content to compromise another member's account or computer environment are strictly forbidden. Please honor our members' privacy by refraining from contacting them with offers, questions, suggestions, or anything unrelated to their Gigs or orders.
Privacy & Identity - Posting or publishing private and confidential information belonging to others is not allowed. Any exchange of personal information necessary for completing a service should occur within the Order Page. Sellers also acknowledge that any information received from the buyer not in the public domain must be used solely for delivering the work and not for any other purpose. Users who communicate outside of Gigred will not be covered by our Terms of Service.
Authentic Gigred Profile - Creating a deceptive identity on Gigred, misrepresenting your identity, establishing a Gigred profile for someone other than yourself (a real person), or attempting to use another user's account or information is prohibited. Your profile details, including your description, skills, location, etc., must be truthful, comprehensive, and not misleading, illegal, offensive, or harmful in any way. Gigred reserves the right to mandate users to undergo a verification process (such as using ID, phone, camera, etc.) for Site usage.
Intellectual Property Claims - Gigred will address clear and comprehensive notices regarding alleged copyright or trademark infringement and/or violation of a third party's terms of service. You can review our Intellectual Property claims procedures here.
Fraud / Unlawful Use - Using Gigred for unlawful purposes or engaging in illegal activities is strictly prohibited.
Abuse and Spam
Multiple Accounts - Users are restricted to having one active Gigred account to prevent fraud and abuse. Any additional accounts identified as created to bypass guidelines, gain competitive advantages, or deceive the Gigred community will be disabled. The creation of multiple accounts in bulk may lead to the disabling of all related accounts. It is important to note that any violations of Gigred's Terms of Service and/or our Community Standards can permanently suspend all accounts.
Targeted Abuse - We do not tolerate users who participate in targeted abuse or harassment towards others on Gigred. This encompasses the creation of multiple new accounts to harass members through our messaging or ordering system.
Selling Accounts - You may not buy or sell Gigred accounts.
The Site, including its overall layout, appearance, design, information, content, and other available materials, is exclusively owned by Gigred and protected by copyright, trademark, and other intellectual property laws. Users are explicitly prohibited from doing the following with respect to the Site or any part, component, or extension of the Site (including its mobile applications): (i) copying, transferring, adapting, modifying, distributing, transmitting, displaying, creating derivative works, publishing, or reproducing it in any manner; (ii) reverse assembling, decompiling, reverse engineering, or attempting to derive its source code, underlying ideas, algorithms, structure, or organization; (iii) removing any copyright notice, identification, or any other proprietary notices; (iv) using automation software (bots), hacks, modifications (mods), or any other unauthorized third-party software designed to modify the Site; (v) attempting to gain unauthorized access to, interfere with, damage, or disrupt the Site or the computer systems or networks connected to the Site; (vi) circumventing, removing, altering, deactivating, degrading, or thwarting any technological measure or content protections of the Site; (vii) using any robot, spider, crawlers, or other automatic device, process, software, or queries that intercepts, “mines,” scrapes, or otherwise accesses the Site to monitor, extract, copy, or collect information or data from or through the Site, or engage in any manual process to do the same; (viii) introducing any viruses, trojan horses, worms, logic bombs, or other materials that are malicious or technologically harmful into our systems; (ix) using the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other users’ enjoyment of the Site; or (x) accessing or using the Site in any way not expressly permitted by these Terms of Service. Users agree not to permit or authorize anyone else to do the preceding.
Aside from the limited right to use the Site under these Terms of Service, Gigred holds all rights, title, and interest in and to the Site (including any intellectual property rights therein). You agree not to take any actions inconsistent with such ownership interests. We reserve all rights related to the Site and its content (excluding UGC), including, without limitation, the exclusive right to create derivative works.
If you offer Gigred any comments, suggestions, or other feedback concerning the Gigred platform, the Site, as well as other Gigred products or services (collectively referred to as "Feedback"), you will be considered to have provided Gigred with exclusive, royalty-free, fully paid-up, perpetual, irrevocable, worldwide ownership rights in the feedback. Gigred is not obligated to implement any Feedback received from users.
Sellers should acknowledge Buyers' potential to share confidential information necessary to deliver the ordered work. Sellers are required to safeguard such confidential information from unauthorized use and disclosure. Therefore, Sellers commit to treating any information received from Buyers as highly sensitive, top-secret, and classified material. In adherence to the above, Sellers specifically agree to (i) maintain strict confidentiality of such information; (ii) refrain from disclosing the information to any third parties; (iii) utilize the information solely for delivering the ordered work; and (iv) obtain the Buyer's permission before copying or reproducing any of the information.
- Gigred retains the right to suspend any account temporarily or permanently disable accounts for violations of these Terms of Service and/or our Community Standards. This includes instances of low-quality services or deliveries and any illegal or inappropriate use of the Site or services.
- If you violate Gigred's Terms of Service and/or our Community Standards, your account may be permanently disabled.
- Users with disabled accounts cannot sell or buy on Gigred.
- Users whose accounts have been disabled due to violations of our Terms of Service and/or our Community Standards may contact our Customer Support team for additional information regarding the violation and the account status.
- Users can choose to activate security features for their accounts to safeguard against unauthorized usage.
- Users must be able to confirm ownership of their accounts through Customer Support by submitting materials that demonstrate ownership.
- Disputes should be addressed using Gigred's dispute resolution tools (found in the 'Resolution Center' on the order page) or by contacting Gigred Customer Support.
- Gigred reserves the right to make occasional changes to its Terms of Service. Gigred will provide an updated version of the terms of service on this page when such changes occur.

User Generated Content
User-generated content ("UGC") pertains to content contributed by users rather than content originated by the Site. All content our users, including buyers and sellers, upload to Gigred constitutes user-generated content. Gigred does not actively review user-uploaded or user-created content for appropriateness, copyright violations, trademarks, or other rights. The user uploading or creating such content assumes sole responsibility for it and the outcomes of using, disclosing, storing, or transmitting it. By uploading or creating content on the Gigred platform, you affirm and guarantee that you either own or have obtained all rights, licenses, consents, permissions, power, and/or authority necessary to use and/or upload such content. Furthermore, you assert that such content or its use on the Site does not and will not (a) infringe or violate any intellectual property, proprietary, or privacy rights, data protection, or publicity rights of any third party; (b) breach any applicable local, state, federal, and international laws, regulations, and conventions; and/or (c) contravene any of your or a third party's policies and/or terms of service. We encourage everyone to report violations along with evidence of ownership as appropriate. Reported content in violation may be removed or disabled.
Moreover, Gigred assumes no responsibility for the content, quality, or standard of service the Sellers offer, including Top Rated Sellers, those offering Promoted Gigs, or others. We do not offer any warranty regarding the gigs, their delivery, or the interactions between buyers and sellers. We recommend users use our rating system, engage with the community, and exercise common sense when selecting suitable services.
When providing a service, Sellers affirm that they possess adequate permissions, rights, and/or licenses to offer, sell, or resell the service on Gigred. Sellers who promote their Gig online must adhere to the laws and terms of service of the advertising platform or relevant website used for promotion. Failure to comply may result in removing the Gig, as applicable, and could lead to suspending the Seller's account.
For detailed terms concerning Intellectual Property rights and the process for reporting claims of copyright infringement (DMCA notices) or trademark infringement, please refer to our Intellectual Property Claims Policy, which is an essential component of these Terms of Service. Please be aware that, in suitable situations, we may disable and/or terminate the accounts of users who repeatedly infringe on intellectual property rights.
Upon purchasing a Gig on Gigred, unless explicitly stated otherwise on the Seller's Gig page or description, the Buyer is granted all intellectual property rights, including but not limited to copyright in the delivered work from the Seller. The Seller waives any moral rights in the work. The Seller expressly assigns the copyright in the delivered work to the Buyer, and this transfer is contingent upon full payment for the Gig. The delivered work and its copyright become the exclusive property of the Buyer in custom-created work, such as art, design, or report generation. In such cases, the Seller agrees to assign all rights to the Buyer upon delivery. Certain Gigs, including those for custom-created work, may require additional payments (via Gig Extras) for a Commercial Use License. If the Gig is purchased for personal use, the Buyer owns all necessary rights without requiring the Commercial Use License. However, if the Buyer intends to use the work for any business-related purpose, a Commercial Use License must be acquired through a Gig Extra, providing broader rights for business use.
For Voice Over Gigs, the Buyer acquires basic rights upon delivery and payment, entailing a one-time fee for perpetual use and non-commercial purposes. If the intention is to use the Voice Over for product or service promotion (excluding paid marketing channels), Commercial Rights (Buy-Out) must be purchased through a Gig Extra. Full Broadcast Rights (Buy-Out) can be obtained through a Gig Extra for usage in radio, television, and internet commercials. More details on the types of buy-outs are provided below.
Moreover, users (both Buyers and Sellers) acknowledge that unless expressly specified otherwise, the content they voluntarily generate/upload on Gigred—such as Gig texts, photos, videos, usernames, user photos, user videos, and any other information, including showcased work—may be utilized by Gigred without compensation for marketing or other purposes.
Voice Over Commercial Buy-Out
When acquiring a Voice Over Gig, the Seller provides you with a non-commercial, everlasting, exclusive, non-transferable, global license to utilize the obtained Voice Over. This excludes any commercial applications, such as radio, television, and internet commercial spots.
By obtaining Commercial Rights (Buy-Out) along with your order, beyond the fundamental rights, the Seller provides you with a license to utilize the Voice Over for any commercial, promotional, and non-broadcast purposes for the agreed-upon period with the Seller (and unless otherwise agreed - indefinitely). Commercial, promotional, and non-broadcast purposes refer to any business-related use for creating or promoting a for-profit product or service (excluding paid marketing channels), such as (for example) explainer videos posted on company websites, social networks, or email campaigns, audiobooks, podcast intros, and strictly excludes any illegal, immoral, or defamatory purposes.
By acquiring Full Broadcast Rights (Buy-Out) along with your order and the Commercial Rights, the Seller provides you with a license for complete broadcasting for the agreed-upon period with the Seller (unless otherwise agreed - indefinitely). Full broadcasting encompasses internet, radio, and TV "paid channels," such as (for example) television commercials, radio commercials, internet radio, and music/video streaming platforms, and strictly excludes any illegal, immoral, or defamatory purposes.
This Buy-Out is governed by Gigred's Terms of Service. No warranty, express or implied, is associated with purchasing this delivery, including fitness for a particular purpose. Neither the Seller nor Gigred will be held liable for any claims or incidental, consequential, or other damages arising from this license, the delivery, or your use of the delivery.
Gig Commercial Use License
By acquiring a "Commercial Use License" along with your Gig Order, the Seller provides you with an everlasting, exclusive, non-transferable, global license to utilize the purchased delivery for Permitted Commercial Purposes. It is emphasized that the Seller retains all ownership rights. "Permitted Commercial Purposes" encompass any business-related use, such as (for instance) advertising, promotion, website creation, integration into products, software, or other business-related tools, and categorically excludes any illegal, immoral, or defamatory purpose. This license is subject to Gigred's Terms of Service. There is no warranty associated with acquiring this delivery, whether expressed or implied, including fitness for a specific purpose. Neither the Seller nor Gigred shall be held responsible for any claims or incidental, consequential, or other damages arising from this license, the delivery, or your utilization of the delivery.
Disclaimer of Warranties
Your utilization of the Site, its content, and any services or items acquired through the Site is undertaken at your own risk. The Site, its content, and any services or items obtained through the Site are presented on an "as is" and "as available" basis, devoid of any warranties, either express or implied. Neither Gigred nor any individual affiliated with Gigred provides any warranty or representation regarding the Site's completeness, security, reliability, quality, accuracy, or availability.
The preceding statement does not impact any warranties that cannot be excluded or limited under applicable law.
Certain user-generated content on the Site can be translated conveniently using translation software powered by Amazon or Google. However, no automated translation is flawless or intended to replace human translators. These translations are provided as a service to Site users and are presented "as is." No warranty of any kind, either expressed or implied, is provided concerning the accuracy, reliability, or correctness of such translations from English into any other language. Some user-generated content, such as images, videos, Flash, etc., may not be precisely translated or translated due to the limitations of the translation software.

These damages include but are not limited to, direct, indirect, special, incidental, consequential, or punitive damages, such as personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
The above limitation or exclusion of liability does not impact any liability that cannot be excluded or limited under applicable law.
As mentioned here, the term "Affiliate" refers to an entity that, directly or indirectly, has control over, is controlled by, or is under common control with Gigred. In this context, control implies possessing more than fifty percent (50%) of the voting stock or other ownership interest or the majority of voting rights in such an entity.
